¿Qué es Una Visa de Prometido(a) y Cómo Funciona?

Si un ciudadano de los EE.UU. quiere casarse con alguien que vive fuera de los EE.UU., pero quiere casarse dentro de los EE.UU., Visa de prometido(a) (visa K Visa , Formulario I- 129F ) es una opción válida. What is a Fiancé(e) Visa and How Does it Work?

If a U.S. citizen wants to marry someone who lives outside the U.S., but wants to be married inside the U.S., a fiancé(e) visa (K Visa, Form I-129F) is a valid option. The fiancé(e) visa allows the U.S. citizen to petition for their fiancé(e), allowing the fiancé(e) to enter the U.S. Once the fiancé(e) enters, the petitioner and fiancé(e) have 90 days to marry. If you are already married, you can file a Fiancé(e) Visa at the same time as Form I-130 (click here to see prior blog post), which may allow your spouse to come to the U.S. sooner.

To petition for a foreign fiancé(e) the U.S. citizen sends Form I-129F, along with necessary proofs, to USCIS.

Deferred Action for Childhood Arrivals (DACA) Renewal

In a previous blog post, we explained what Deferred Action for Childhood Arrivals (DACA) is, and who qualifies. Recently, USCIS announced that it is beginning the renewal process for certain types of DACA recipients (only those granted DACA through by Immigrations and Customs Enforcement (ICE) from June 15, 2012 to August 15, 2012.) However, USCIS also has given guidelines for what to expect for all other DACA recipients to renew and receive a work permit for another two years.

Consular processing for immediate relatives

If you or your immediate relative entered the U.S. originally without a visa or your immediate relative is outside the U.S., you or they can obtain permanent resident status through “consular processing.” The U.S. citizen or permanent resident relative must first file an I-130 Petition for Alien Relative (See prior blog post). Once that petition is approved, the immediate relative will be able to apply for residency through a U.S. consulate abroad.

Un escenario común entre nuestros clientes es que el cliente tiene un pariente inmediato (cónyuge, padres, hijos menores de 21) que tiene o que puede hacerle una petición con el Formulario I -130 (que se explica en un blog anterior), pero el cliente entró a los EE.UU. sin una visa o inspección. Como existen leyes de inmigración en la actualidad, una persona que ha entrado en los EE.UU. sin una visa o inspección no puede procesar su residencia (green card), que normalmente se hace con el Formulario I- 485, mientras que esté en los EE.UU., debido a que no fueron originalmente inspeccionados ni admitidos (hay algunas excepciones). La persona que solicita la residencia tiene que hacerlo desde fuera de los EE.UU. a través del "proceso consular."

Understanding the I-601A - Unlawful Presence Waiver

A common scenario among our clients is that the client has an immediate relative (spouse, parent, child under the age of 21) who has or who can petition for them with Form I-130 (explained in a previous blog post), but the client entered the U.S. without a visa or inspection. As immigration laws exist currently, a person who has entered the U.S. without a visa or inspection cannot process their residency (green card), which would normally be done with Form I-485, while in the U.S., because they were not originally inspected and admitted (there are some exceptions). The person who is applying for residency must do so from outside the U.S. through “consular processing.”

What is Deferred Action for Childhood Arrivals (DACA)?

Immigration reform has been a hotly debated political topic for years now. It seemed inevitable just a couple of years ago that immigration reform would happen, granting new alternatives for people living in the U.S. without proper status. Although immigration reform may eventually happen, (see article) the Obama administration has offered short-term relief to certain people who arrived to the U.S. under the age of 16.

This program, known as Deferred Action for Childhood Arrivals (DACA), began on August 15, 2012. While it does not offer permanent lawful status, it does grant a two-year work permit.
